These Terms of Service (“Terms”) govern your use of the WhatsApp-based loyalty, rewards, and engagement services offered by Tuanis Resto Bar (“Tuani’s”, “we”, “us”). By using our services, you agree to these Terms.
You must be 18 or older. Our services relate to a restaurant and bar that serves alcohol. By using them you confirm you are at least 18 years old and of legal drinking age. We do not knowingly provide services to minors.
1. Acceptance of these Terms
By submitting your WhatsApp number, verifying it, or otherwise using our services, you accept these Terms and our Privacy Policy. If you do not agree, please do not use the services.
2. Eligibility
You must be at least 18 years old and capable of forming a binding agreement. You agree to provide accurate information, including a phone number that belongs to you, and to keep it current.
3. What we provide
Our services may include: digital coupons and rewards, a customer profile tied to your verified WhatsApp number, optional sports-related prediction features, and messages sent to your WhatsApp. Features may change, be added, or be withdrawn at any time.
4. Verification & your account
We verify your phone number with a one-time passcode sent via WhatsApp. Your verified number acts as your account identifier. You are responsible for keeping access to your phone and WhatsApp account secure. Do not use a number you do not control.
5. WhatsApp messages
When you opt in, you agree to receive messages from Tuani’s at your WhatsApp number, which may include verification codes, coupons, and — where you consent — marketing. You can stop marketing messages anytime by replying STOP or BAJA. Carrier message and data rates may apply.
6. Coupons, rewards & predictions
- Coupons and rewards have no cash value, cannot be exchanged for cash, and may carry expiration dates, limits, and conditions shown at the time of issue.
- Unless stated otherwise, offers are limited to one per person per visit and cannot be combined with other promotions.
- We may modify, suspend, or cancel any offer, reward, or feature at our discretion.
- Any sports-prediction feature is offered as a free promotional game for entertainment. It is not gambling and requires no payment or wager. Rewards, where offered, are granted at our discretion and subject to the rules shown with the feature and to applicable law.
Fair use. Coupons, rewards, and predictions are for personal, non-commercial use. Fraud, automation, duplicate accounts, or abuse may result in forfeiture of rewards and suspension of access.
7. Acceptable use
You agree not to misuse the services, including by attempting to interfere with them, access them through unauthorized means, submit false information, impersonate others, or use them for any unlawful purpose.
8. Intellectual property
The Tuani’s name, logo, content, and materials are owned by Tuanis Resto Bar or its licensors and are protected by law. You may not copy, reproduce, or use them without permission.
9. Disclaimers
The services are provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the services will be uninterrupted, error-free, or that messages will always be delivered, since delivery depends on third parties such as WhatsApp and your carrier.
10. Limitation of liability
To the fullest extent permitted by law, Tuanis Resto Bar will not be liable for indirect, incidental, special, or consequential damages arising from your use of the services. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted here with a new effective date. Continued use after changes means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the Republic of Nicaragua, without regard to conflict-of-law principles. Disputes will be subject to the competent courts of Nicaragua, except where applicable law provides otherwise.
